You have to file a lawsuit within three years of your accident. Otherwise, you will not have the right to do so because the statute of limitations will have been reached. Three years may seem like a long time, but it can go by quickly, especially if you are in the middle of an ongoing healthcare crisis. For example, if your injuries were severe and you need surgeries, physical therapy, etc., filing a lawsuit is probably the last thing on your mind. This is why it is best to hire an attorney as soon as possible. You can continue to focus on your medical care while your attorney builds your case behind the scenes and makes sure your lawsuit is filed appropriately.

When to File Your Accident Claim

When working with a personal injury attorney, you can open a claim with your insurance company immediately. They will provide you with a claim number you can use when going to the doctor or having the repair work done on your vehicle. Then, an attorney can work with the insurance company to try and negotiate a fair settlement. When necessary, a lawsuit will be filed in court prior to the statute of limitations being reached. Even if you are not fully recovered, the case needs to be filed before you reach it.

Projecting Forward

If you are still undergoing medical treatments when your case is filed, projections will need to be made by your doctor and attorney regarding how much your care is likely to cost in the future. This is standard practice so as long as your attorney is familiar with handling injury cases, you shouldn’t have an issue. Just remember that the experience level of your attorney can make the difference between an adequate settlement and a fantastic one.
