How long will my car accident case take?

When clients first call or visit our offices, they have many legitimate questions about the legal process, costs associated with cases, and, overall, about how detailed, stressful and time-consuming the process can be.

However, the most common question is simple: “How long is this going to take?”

“They’ve heard about cases similar to their own taking years and years and years, and, frankly, there are a small number of cases that can take, two, three, even four years to resolve,” says Partner Rob Greenstein. “However, that’s not usually the case.”

Without promising miracles, Greenstein can honestly say, “The majority of cases in our office can be resolved within a year.”

There are no guidelines in determining how long it will take to conclude a case. However, the good news for many victims is that the majority of personal injury cases are settled without the necessity of litigation. Many variables impact the time this legal process takes, including the type of injury or injuries you’ve sustained, the medical treatment you require, and whether the case can be settled or requires a jury trial.
Equally important with accident claims is the question, “How long do I have to make a claim?” In these cases, the amount of time you have to file a claim usually depends on the circumstances of the accident. However, in New York, you generally have three years to file a lawsuit for negligence claims.
Negligence claims include car and other types of vehicular accidents, as well as slip and fall cases. Remember, if the responsible party involves a municipality, you may be required to file notice of a claim within a shorter period of time following the date of the incident. In addition, if a lawsuit has not initiated within the time required, you will lose your rights to make a claim for compensation for your injuries.

At Greenstein & Milbauer, we’ve handled thousands of cases. Experience has taught us that its essential to contact an attorney as soon as possible after you have been injured, because the earlier you reach out, the easier the process for investigating the situation and the easier it is to protect your legal rights.
